Appeal
If you disagree with a court ruling, you can appeal to the Court of Appeal (gerechtshof). The Court of Appeal fully reassesses the case. You can raise new arguments and submit additional evidence.
Appeal must be filed within three months of the ruling. It is essential to seek legal advice promptly to preserve your rights to appeal.
Important: Strict 3-month deadline after the ruling.
Do not wait too long. Once the appeal period has expired, you lose your right to appeal.
When is appeal worthwhile?
Cassation at the Supreme Court
After a ruling by the Court of Appeal, cassation is available at the Supreme Court (Hoge Raad). The Supreme Court does not re-examine the facts, but checks whether the law was correctly applied. Cassation is specialised work we advise you on the prospects and risks.
