Full Proceedings
Full proceedings (bodemprocedure) is a complete civil procedure that results in a definitive judgment. Unlike summary proceedings, the court fully assesses the dispute on its merits and gives a final ruling on the rights and obligations of the parties.
Full proceedings typically take longer than summary proceedings, but offer more opportunities for evidence, witness hearings and expert reports. As a litigation lawyer we guide you from start to finish.
Course of full proceedings
1. Summons
The procedure starts with a summons by which the defendant is called before the court.
2. Statement of Defence
The defendant files a written defence.
3. Hearing (comparitie)
Parties are heard by the judge, who asks questions and tries to promote a settlement.
4. Further submissions (if any)
Parties may file additional documents with further arguments and evidence.
5. Judgment
The court renders judgment typically 6 weeks after the last procedural step.
